Terms of Service

These Terms are between you and The Memizy Project ("Memizy", "we", "us"). Memizy provides three browser-based products: Memizy Learn (an interactive learning platform), Memizy Studio (a local-first video editing suite), and Memizy Slides (an AI-powered presentation tool).

Všechny tři produkty Memizy jsou postaveny na filozofii local-first. Váš obsah ve výchozím nastavení nikdy neodesíláme na naše servery:

• Memizy Studio: Veškeré úpravy videa, zpracování zvuku a přepis vykonává zcela procesor vašeho prohlížeče. Soubory nikdy neopustí vaše zařízení.

• Memizy Slides: Veškerý obsah je vytvářen a ukládán lokálně. Soubory prezentací nikdy neopustí vaše zařízení.

• Memizy Learn – lokální / anonymní režim: Vaše studijní sady a pokrok jsou uloženy výhradně v IndexedDB vašeho prohlížeče. Ve výchozím nastavení se na naše servery nepřenáší žádná data. Pokud se rozhodnete využít naše AI funkce, vaše textové prompty jsou dočasně odeslány na naše servery pouze za účelem zpracování v reálném čase a nejsou trvale ukládány. Tento režim neshromažďuje žádné osobní údaje.

• Memizy Learn – Multiplayer režim: Živé herní události (jako jsou skóre a odpovědi) jsou přenášeny přes dočasné webové sockety a neukládají se do žádné databáze. Základní metadata relace (jako je PIN místnosti a její stav) jsou dočasně uložena pro umožnění spojení.

Cloudový účet je volitelný a dostupný pouze v Memizy Learn. Pokud se rozhodnete jej vytvořit, shromažďujeme: (a) Vaši e-mailovou adresu, používanou výhradně pro autentizaci. (b) Vaše studijní sady a studijní pokrok, zašifrované a uložené na našich serverech pro synchronizaci mezi zařízeními. (c) Statistiky používání aplikace spojené s vaším účtem (např. celkový čas studia, dokončené položky a počty použití AI nebo multiplayerových relací) za účelem sledování vašeho pokroku a vylepšování platformy. Nesbíráme platební údaje (služba je zdarma). Vaše osobní údaje nikdy neprodáváme, nepronajímáme ani nevyměňujeme třetím stranám.

You retain full ownership of all content you create, upload, or process using any Memizy product — including study sets, presentations, and video files.

You are SOLELY RESPONSIBLE for the legality, accuracy, and intellectual property rights of all content you create or process. By using our services, you represent and warrant that: (a) You hold all necessary rights, licences, or permissions for any content you upload, process, or share. (b) Your content does not infringe any third-party copyright, trademark, patent, trade secret, or other intellectual property right. (c) Your content does not violate any applicable law or regulation.

Memizy does not endorse, review, or take responsibility for user-generated content. Memizy holds zero liability for any copyright infringement, intellectual property claim, or legal dispute arising from content you create, process, or share using our tools. Any such claim is your sole responsibility to defend and resolve.

Memizy supports a community plugin system (available in Memizy Learn and, in future, other products). Community plugins are created by third-party developers and are NOT reviewed, audited, or endorsed by The Memizy Project unless explicitly marked as "Official".

You install and use third-party community plugins entirely AT YOUR OWN RISK. Memizy makes no representations about the safety, security, accuracy, or stability of any third-party plugin. The Memizy Project is NOT liable for: (a) Any data loss, data corruption, or destruction of locally stored content caused by a third-party plugin. (b) Any security vulnerability, privacy breach, or unauthorised data access introduced by a third-party plugin. (c) Any instability, crashes, or malfunction of the Memizy application caused by a third-party plugin. (d) Any illegal, harmful, or deceptive behaviour of a third-party plugin.

Before installing any plugin, we encourage you to review its source code (when available on GitHub) and only install plugins from developers you trust.

You may use all Memizy products for personal, educational, and commercial purposes. You retain full ownership of all output you generate. There is no restriction on the volume of local content you create.

You agree not to: (a) use any Memizy product to create, process, or distribute content that is unlawful, defamatory, harassing, obscene, or harmful to others; (b) reverse-engineer, decompile, or attempt to extract source code from any proprietary component of any Memizy product; (c) attempt to circumvent authentication, security controls, or access other users' data; (d) use automated scripts, bots, or crawlers to abuse or scrape our services; (e) impersonate Memizy or its contributors; (f) resell, sublicence, or redistribute access to our cloud services.

All Memizy products are provided "AS IS" and "AS AVAILABLE", without warranty of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not guarantee uninterrupted availability or error-free operation.

CRITICAL: Browser-based local storage (IndexedDB and LocalStorage) is inherently volatile. It can be automatically cleared by the browser when disk space is low, when the browser is updated, or when you clear your browsing data. Memizy is NOT LIABLE for any loss of locally stored study sets, presentation files, or project data arising from browser storage being cleared. You are solely responsible for exporting and backing up your work. We strongly recommend using the export functionality built into each product regularly.

To the fullest extent permitted by applicable law, The Memizy Project and its contributors shall not be liable for any indirect, incidental, special, exemplary, or consequential damages — including but not limited to: loss of data, loss of study progress, loss of presentation files, security incidents caused by third-party plugins, or service interruptions — arising from your use of or inability to use any Memizy product.

The core Memizy application code is the intellectual property of The Memizy Project. Community-contributed plugins and themes retain their own licences as specified by their respective authors. You retain all rights to your own content. Memizy grants you a limited, non-exclusive, non-transferable licence to use the products for their intended purposes.

We reserve the right to modify, suspend, or discontinue any Memizy product or feature at any time. We will make reasonable efforts to communicate material changes in advance. Continued use after changes are posted constitutes acceptance of the revised Terms.

These Terms are governed by the laws of the Czech Republic, without regard to conflict-of-law principles. Any dispute shall first be subject to a 60-day good-faith negotiation period. If not resolved, disputes shall be submitted to the competent courts of the Czech Republic.
